1. INTRODUCTION
Amateur Radio Digital Communications, Inc. (“ARDC”) respects the privacy of visitors to ARDC’s websites and grant applications systems (“you”) and is committed to protecting your privacy through compliance with this Privacy Policy (the “Policy”). ARDC established this Policy to explain the information that is collected through ARDC’s websites, how that information is used, and protections for your personal information.
As used in this Policy, “ARDC” or “we” refers to ARDC staff, board members, interns, volunteers, and consultants, who are bound by law or contract to keep confidential information they receive as part of their assistance to ARDC. The “Website” refers to ardc.net and ampr.org.
This Policy applies to information that ARDC collects on the Website, as well as information that ARDC collects in emails and other electronic messages exchanged with the Website. This Policy does not apply to information collected by ARDC offline or through other means.
Please read this Policy carefully to understand ARDC’s policies and practices regarding your information and how we will treat it. If you do not agree with ARDC’s policies and practices, do not use our Website. By accessing or using this Website, you agree to this Policy.
2. INFORMATION THAT YOU PROVIDE TO ARDC
ARDC collects and retains information that you voluntarily submit to ARDC. It is up to you whether to submit such information to ARDC, and how much information to provide.
If you chose to create an account, join a mailing list, complete a survey, apply for a grant, or make an inquiry to ARDC using the Website, ARDC may request and retain personally identifying information such as your name, email address, mailing address, phone number, IP address, date of birth and/or amateur radio callsign. If you apply for a grant from ARDC, ARDC may also ask for additional personally identifying information, such as your tax identification number, bank account number, and/or other financial information. In this Policy, such information that relates to an identified or identifiable natural person is “Personal Information.”
ARDC will retain your Personal Information for as long as reasonably necessary for the purpose for which it was retained. When Personal Information is retained, ARDC will delete the information as soon as it is apparent that the information is no longer needed for the purpose for which it was retained, for ARDC’s mission, or for the Website’s functionality.
3. INFORMATION THAT YOU POST TO THE WEBSITE
ARDC collects and retains information that you voluntarily submit to be published or displayed (“posted”) on public areas of the Website or transmitted to other users of the Website or third parties. In this policy, such information users submit for posting is called “User Contributions.”
Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable, and ARDC cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, ARDC cannot and does not guarantee that your User Contributions will not be viewed by unauthorized persons.
When User Contributions are retained, ARDC will delete the information as soon as it is apparent that the information is no longer needed for the purpose for which it was retained, for ARDC’s mission, or for the Website’s functionality.
4. INFORMATION THAT ARDC AUTOMATICALLY COLLECTS VIA THE WEBSITE
ARDC uses session cookies on certain portions of the Website, which expire when you close your browser. ARDC does not use persistent ID cookies on this Website, except where you click “remember me” or are logged in to your account.
ARDC collects and retains information through automatic logging as you visit the website. In this Policy, such data collected through these means is “Automatically Collected Data.”
ARDC will retain your Automatically Collected Data for as long as reasonably necessary for ARDC’s mission and the Website’s functionality. ARDC will delete the information as soon as it is apparent that the information is no longer needed for the purpose for which it was retained, for ARDC’s mission, or for the Website’s functionality.
5. USES OF YOUR INFORMATION
ARDC may use information that ARDC collects about you or that you provide to ARDC, including any Personal Information, Automatically Collected Information, and User Contributions, for the following bases: (i) to fulfill a purpose for which you provide it; (ii) to present the Website and its contents to you; (iii) to provide you with information or services that you request from ARDC; (iv) to carry out ARDC’s obligations and enforce ARDC’s rights arising from any contracts entered between you and ARDC: (v) to notify you about changes to the Website or any services offered or provided through it; (vi) to allow you to participate in interactive features on the Website; (vii) in any other way ARDC may describe when you provide the information; or (viii) for any other purpose with your consent.
6. DISCLOSURE OF YOUR INFORMATION
ARDC may disclose aggregated and/or anonymized information about our users, and information that does not relate to an identified or identifiable individual, without restriction.
ARDC may disclose Personal Information as follows: (i) to contractors, service providers, and other third parties who support ARDC and are bound by contract to keep personal information confidential and use it only for the purposes for which ARDC discloses it to them; (ii) to fulfill the purpose for which you provide it; (iii) for any other purpose disclosed by ARDC when you provide the information; (iv) with your consent; (v) to comply with any court order, law, or legal process; (vi) to enforce or apply our Terms of Use and other agreements; and/or (vii) if ARDC believes disclosure is appropriate to protect the rights, property, or safety of ARDC or others.
ARDC does not sell or rent your Personal Information, Automatically Collected Information, or User Contributions under any circumstances, and ARDC does not share your Personal Information without prior consent except as compelled by law. This restriction applies to personal information that ARDC collects online and offline.
ARDC does not employ any automated decision-making system that processes your Personal Information in a manner that produces a legal or similarly significant effect (such as profiling), unless ARDC obtains your further explicit consent to such automated decision-making or enters a contract with you that requires such automated decision-making to occur.
7. YOUR RIGHTS REGARDING YOUR INFORMATION
ARDC would like to make sure you are fully aware of all your data protection rights. Your data protection rights may differ based on where you are located.
If you are located in the European Union or the United Kingdom, you may be entitled to the following rights: (i) the right to request ARDC for copies of your personal data (ARDC may charge a small fee for this service; (ii) the right to request that ARDC correct or complete any information that you believe is inaccurate or incomplete; (iii) the right to request that ARDC erase your personal data, under certain conditions; (iv) the right to request that ARDC restrict the processing of your personal data, under certain conditions; (v) the right to object to ARDC’s processing of your personal data, under certain conditions; (vi) the right to request that ARDC transfers the data that we have collected to another organization or directly to you, under certain conditions; (vii) and the right to file a complaint with your local supervisory authority.
If you are a resident of Brazil, you may be entitled to the following rights: (i) the right learn what information ARDC possesses about you and how ARDC uses it; (ii) the right to request that ARDC correct or complete any information that you believe is inaccurate or incomplete; and (iii) the right to request that ARDC delete your personal data, under certain conditions.
If applicable, you may access, correct, update, or delete your Personal Information by sending an email requesting changes to privacy@ardc.net.
8. CHILDREN’S PRIVACY AND PARENTAL CONTROLS
If you are under the age of 18, you may be entitled to additional protections for your information and privacy online. You may not agree to this Privacy Policy or Website Terms of Use or any other terms if you are under 18 years old. Users under the age of 18 (“Minor Users”) require a parent or legal guardian (a “Guardian”) to allow them to use the Website and to agree to these Terms of Use and the Privacy Policy. By permitting a Minor User to use the Website, the Guardian of the Minor User becomes subject to our Website Terms of Use and agrees to be responsible for the Minor User’s activities on the Website.
If you (or your Guardian, as may be applicable) do not agree to the Website Terms of Use or the Privacy Policy, you may not use the Website.

9. ACCESSING, CORRECTING, UPDATING, OR REMOVING YOUR INFORMATION
You may access, correct, update, or delete your Personal Information by sending an email requesting changes to privacy@ardc.net. If you create an account on the Website, you may also access or delete your Personal Information on the account page.
You may withdraw your consent to receive emails from ARDC by sending an email to privacy@ardc.net with the subject line “Unsubscribe Me.”
You may unsubscribe to an ARDC mailing list by following the instructions provided for the “Unsubscribe” link in the newsletter, or by sending an email to postmaster@ardc.net with the subject line “Unsubscribe Me.”
You may otherwise withdraw your consent, restrict, or object to ARDC’s processing of your data by sending an email to privacy@ardc.net with the subject line “Withdrawal of Consent.”
Please note that ARDC cannot delete your personal information except by also deleting your user account. ARDC may not accommodate a request to change information if ARDC believes the change would violate any law or legal requirement or cause the information to be incorrect.
10. DATA STORAGE AND RETENTION
ARDC will retain your information for as long as reasonably necessary for the purpose for which the data was collected and retained unless longer retention is necessary to comply with contractual or legal requirements. ARDC will delete the information as soon as it is apparent that the information is no longer needed for the purpose for which it was retained or for legal reasons. Information regarding your user account is retained until you choose to delete your account. Email subscriptions information is retained until you unsubscribe from the mailing list(s).
Financial records of grants, donations and other transactions are retained indefinitely in electronic format. Check copies and payment distribution details are normally kept up to seven years. Donor and grantee information is kept indefinitely unless the individual requests removal.
If ARDC inadvertently collects more personal information than intended, ARDC endeavors to delete the extraneous information. When ARDC no longer needs to retain information or when deleting information on request, ARDC endeavors to remove all copies. However, that deleted information may continue to persist on backup media.
11. DATA TRANSFERS
ARDC is based in the United States of America, but ARDC utilizes an international network of volunteers and service providers. Therefore, your Personal Information may be internationally transferred and processed within the European Economic Area, the European Union, the United Kingdom, and any other countries which have adequate data privacy safeguards for international transfers of Personal Information according to the European Commission.
Your Personal Information may also be internationally transferred to and processed in the following countries, which do not have adequate data privacy safeguards according to the European Commission: the United States of America and Canada (for non-profit organizations). When your personal information is transferred to and processed in such countries, ARDC adopts appropriate safeguards and adopts Standard Contractual Clauses where appropriate.
12. DATA SECURITY
ARDC has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. When you receive a password for access to certain parts of the Website, you are responsible for keeping this password confidential.
Unfortunately, the transmission of information via the internet is not completely secure. Although ARDC endeavors to protect your personal information, ARDC cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. ARDC is not responsible for circumvention of any privacy settings or security measures contained on the Website.
13. CHANGES TO OUR PRIVACY POLICY
This Policy was last revised on the date listed under the title above.
ARDC posts any changes we make to this Policy on this page. If ARDC makes material changes to how we treat our users’ personal information, ARDC will notify you through a notice on the Website home page. You are responsible for periodically visiting our Website and this Policy to check for any changes.
